As the clock strikes midnight on January 1, 2024, Portugal is rolling out a series of transformations following the implementation of Decree-Law no. 109/2023 regarding the Non-Habitual Resident program. This update, initially tailored to address the urgent needs arising from the COVID-19 pandemic, introduces notable alterations to the country’s border control framework.
The most significant change involves a restructuring of the Portuguese border control system, redistributing administrative responsibilities from the now-disbanded Foreigners and Borders Service (SEF) to seven distinct entities, notably the AIMA. This overhaul carries substantial implications, especially for individuals holding documents or visas nearing their expiration dates.
According to the updated Decree-Law, documents and visas set to expire on November 25 or within 15 days preceding it will retain validity until June 30, 2024. This extension offers a much-needed relief for those facing imminent expiration, affording them additional time to navigate bureaucratic procedures. For individuals with documents expiring on or after November 25, 2023, or within the immediate 15-day period prior, there’s reason to celebrate: your documents not only remain valid until the generous extension deadline but could also be considered afterward if you can demonstrate that you’ve initiated the renewal process by scheduling an appointment.
However, it’s critical to note that post-June 30, 2024, the acceptance of documents and visas for stays in Portugal will hinge upon holders demonstrating proactive scheduling of their renewal. This underscores the significance of staying on top of administrative deadlines to ensure uninterrupted stays in the country.
It’s crucial to highlight that these regulatory changes do not encompass documents issued under Council of Ministers Resolution 29-A/2022, dated March 1, which delineates specific criteria for offering temporary protection to displaced individuals from Ukraine.
